TERMS OF SERVICE

1. Introduction & Legal Entity

These Terms of Service ("Terms") govern your access to and use of the HIRICA X platform ("Platform"), operated by HIRICA X ("we," "us," "our").

By accessing, registering for, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Nature of Services — Fully Automated SaaS Platform

HIRICA X is a fully automated Software-as-a-Service (SaaS) platform that conducts AI-powered voice interviews, generates real-time transcriptions, performs behavioral and sentiment analysis, and produces candidate assessment scorecards.

No human-led consulting, recruiting, staffing, or manual evaluation services are provided. All services are delivered solely through automated software infrastructure. No human interviewer, recruiter, or consultant is involved at any stage of the interview or assessment process. The Platform is a technology product, not a recruitment agency or staffing service.

3. Account Registration & Eligibility

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security and confidentiality of your account credentials. You must be at least 18 years old or the age of majority in your jurisdiction. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Billing

HIRICA X offers multiple subscription tiers: Genesis (Free), Growth, Scale, Titan, and Enterprise. Paid plans are billed on a recurring monthly or annual basis.

Payment Processing & Merchant of Record: All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle handles billing, payment processing, tax collection, and invoicing on our behalf. By purchasing a subscription, you also agree to Paddle's Terms of Use and Privacy Policy.

Refunds: Refund requests are handled in accordance with our Refund Policy and Paddle's refund procedures. We reserve the right to modify pricing with 30 days' advance notice. Usage limits reset on each billing cycle.

5. Interview Recording & AI Analysis

By using the Platform, you acknowledge that: (a) all interviews are conducted and analyzed entirely by artificial intelligence with no human involvement; (b) audio recordings and transcripts are stored for assessment purposes; (c) explicit candidate consent is obtained before any interview recording begins; (d) behavioral analysis, sentiment scoring, and AI-generated summaries are provided as decision-support tools and do not constitute definitive hiring recommendations.

6. Data Ownership & Usage

Organizations retain ownership of their interview data, candidate information, and assessment results. HIRICA X may use anonymized, de-identified data to improve its AI models and services. No personally identifiable information is used for model training without consent. See our Privacy Policy for details.

7. Acceptable Use

You agree not to: (a) use the Platform for discriminatory hiring practices or in violation of any applicable employment or anti-discrimination laws; (b) attempt to manipulate, circumvent, or game AI assessments; (c) share candidate recordings or data without proper authorization or consent; (d) reverse engineer, decompile, scrape, or attempt to extract source code from the Platform; (e) use the Platform for any unlawful purpose or in a manner that could damage, disable, or impair the Platform.

8. Intellectual Property

The Platform, including all AI models, algorithms, interfaces, designs, and branding, is the intellectual property of HIRICA X. Your subscription grants a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during your active subscription period.

9. Limitation of Liability

HIRICA X provides AI-generated assessments as decision-support tools only. We do not guarantee the accuracy, completeness, or reliability of any AI analysis. All hiring decisions remain the sole responsibility of the subscribing organization. HIRICA X shall not be liable for any hiring decisions made in reliance on Platform assessments. To the maximum extent permitted by applicable law, our total aggregate liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Cancellation & Termination

You may cancel your subscription at any time through the billing portal in your dashboard. Upon cancellation, your subscription remains active until the end of the current billing period. No further charges will be applied after the current period expires. We may suspend or terminate your account for violation of these Terms. Upon termination, previously generated reports remain available for 90 days for data export.

11. Dispute Resolution & Governing Law

Any disputes arising from or related to these Terms shall first be addressed through good-faith informal resolution by contacting support@hiricax.com. If informal resolution is unsuccessful within 30 days, disputes shall be resolved through binding arbitration in accordance with applicable laws. These Terms are governed by applicable law in the jurisdiction of HIRICA X' principal place of business.

12. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms.
